CreditLawGroup.com is comprised of licensed attorneys who
operate under the strict supervision of various bar associations and under
ethical guidelines set forth in the Rules of Professional Conduct. We operate
from with professional support staff and the latest technology.
Attorney Client Privilege - All
communications with the firm are subject to the attorney client privilege and
are confidential to the extent covered by the privilege. Do you really want to
be sending confidential credit and personal identifying information to unknown
companies or nameless and faceless internet websites just because they may look
nice? Information which is not covered by the attorney client privilege may
be subject to discovery, subpoena or other disclosure. While there
are many exceptions and scenarios that may affect the attorney-client
privilege, only a law firm or attorney can provide such a safeguard.
Legal Action -As with many statutes,
violation of the Fair Credit Reporting Act carries penalties and the ability to
file a lawsuit or take other action to enforce its terms. Only attorneys are
permitted to file suit in court subject to the rules of a particular
jurisdiction. So called "credit repair" companies and non-attorneys have no
authority to commence legal action or represent clients in a court of law and
in many states the engagement in such activity is a crime referred to as the
"unauthorized practice of law." The threat of prospective legal claims and
governmental regulatory action is what helps police the credit bureaus and
ensure compliance with federal law. The credit bureaus routinely ignore so
called "credit repair" companies for good cause. Many are unscrupulous and
fraudulent operations which engage in deceptive practices.
Representation -Law firms can provide legal
representation on issues related to federal consumer and banking law. The
entire credit reporting system is governed by a series of complex laws and an
interpretation on the application of these laws. Various regulatory bodies
including the Federal Trade Commission and bank regulators issue their own
opinions as to the application of these statutes. While the process of
disputing inaccurate or unverifiable information on your credit report may seem
to be basic there are a myriad of legal issues which may come into play. Just
as you might not want to have your plumber give advice on a real estate closing
are you willing to entrust your credit and the interpretation of the law to
some unidentified person or company sending correspondence in your name?
Impact -The retention of a law firm provides
notice that you are paying attention to your credit reports and the impact of
correspondence from a law firm shows the credit reporting agencies that you
mean business.
